Please take a moment to carefully review the following Terms of Service. These terms form a binding legal agreement between you (the client) and our company. By scheduling or using our services, you agree to be bound by these terms.

 

1. Company Information & DBA Disclosure

49er Scoops is a legally registered division and doing-business-as (DBA) name of our parent company, Summit Property Care LLC.

  • Throughout this agreement, terms like "the Company," "we," "us," or "our" refer jointly to Summit Property Care LLC and 49er Scoops.

  • Please note that service notifications, automated reminders, agreements, invoices, and credit card statements may display either 49er Scoops or Summit Property Care LLC. Both names represent the exact same legal entity, and all protections outlined in these terms apply equally to both.

2. Friendly Communication & SMS Policy

We love staying in touch to keep your services running smoothly! By submitting your information via any form on our website or signing up for service, you give us permission to communicate with you via phone calls, emails, and text (SMS) messages.

  • What we send: We promise to only message you when necessary. This includes quote updates, day-of service reminders, billing alerts, or the occasional neighborhood special offer.

  • Frequency & Rates: Text frequency varies based on your service schedule but will generally not exceed 4 messages per month. Standard text message and data rates from your mobile carrier may apply.

  • Opting Out: Your peace of mind matters to us. Your information will never be sold or shared with outside marketers. If you ever wish to stop receiving text messages, simply reply STOP or END to any text message to be opted out immediately.

3. Service Description

Our company offers comprehensive pet waste removal services designed for both residential and commercial properties. Our team will thoroughly clean up pet waste from your designated areas and dispose of it in an environmentally friendly, responsible manner. We utilize high-quality equipment and sanitation techniques to ensure your outdoor space is left clean, hygienic, and ready to enjoy.

4. Service Availability & Holidays

Our service is available in specific geographic regions, and we make every effort to accommodate all our neighbors. However, service availability is subject to change based on route volume and scheduling limits.

  • We reserve the right to refuse service to any property if we determine that the environment is unsafe, inaccessible, or unfeasible for our team.

  • Holidays: We observe major national holidays to let our team spend time with their families. If your regular service day falls on a holiday, we will notify you in advance of your rescheduled service day for that week.

5. Payment & Card on File

To keep our operations smooth and efficient, we use a convenient digital billing system.

  • Card on File: To secure your ongoing service, we require a valid credit or debit card to be securely saved on file through our client portal.

  • Payment Due Dates: Payment for your service is required prior to your next scheduled follow-up appointment. While portal payments are preferred, we also accept cash or checks, provided they are received before the next scheduled visit.

  • Late Fees: We reserve the right to pause service or assess a reasonable late fee for any payments not received by the next follow-up appointment. This fee will be automatically added to your next invoice.

6. Access to Your Property

To do our jobs effectively, you agree to provide our team with safe, unobstructed access to the designated pet waste removal areas on your service day (e.g., ensuring gates are unlocked and free of structural blocks).

  • If our team arrives and cannot access the yard due to a locked gate or blocked entry, we reserve the right to skip or reschedule the appointment, and a missed-appointment fee may apply to cover our team's time and fuel.

  • While we treat your property with the utmost respect, the Company is not liable for minor wear-and-tear or unavoidable accidental damages to property (such as gate latches or turf wear) occurring during normal service operations.

7. Cancellation & Rescheduling

We understand that life happens and schedules change! If you need to pause, cancel, or reschedule your service, please notify us at least twenty-four (24) hours prior to your scheduled appointment time. If you fail to provide sufficient notice and our team is already en route or arrives at your property, we reserve the right to charge a missed-service fee to cover our team's time and gas.

8. Weather Policy

We are dedicated to showing up rain or shine! However, the safety of our team is our top priority. We reserve the right to pause or reschedule service in the event of severe, inclement weather. This includes lightning, active thunderstorms, dangerously high winds, extreme heat, or heavy snowfall.

  • In the event of a weather postponement, we will notify you as quickly as possible and work to make up the service at the earliest safe opportunity.

  • The Company is not responsible for any issues, accumulation, or inconveniences resulting from weather-related service adjustments.

9. Safe Waste Hauling & Disposal

As part of our standard or optional service tiers, we may haul away the pet waste we collect from your yard. We dispose of all waste in an environmentally responsible manner in strict compliance with local, state, and federal regulations.

  • Please note that we cannot handle, clean, or dispose of hazardous chemical waste, non-canine/feline waste, or other legally prohibited materials.

  • You agree to indemnify and hold Summit Property Care LLC and 49er Scoops harmless from any third-party claims, environmental fees, or expenses arising from the standard disposal of pet waste collected from your property.

10. Pet Safety & Aggressive Animals

We love dogs, but we need to keep our scoopers safe! For the safety of our employees, we kindly ask that all dogs be secured safely inside the home or a separate enclosure during our service window.

  • If a dog is left loose in the yard and shows signs of aggression or prevents our team from safely entering, we reserve the right to immediately skip the service, and a standard service fee will still apply.

  • You agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the behavior or actions of your pets during our service visit.

11. Dog Bite Policy

The safety of our team is non-negotiable. In the rare and unfortunate event that an employee is bitten or attacked by an unsecured dog on your property, the fault and liability will rest solely with the pet owner.

  • We will immediately terminate the service, leave the property, and seek medical attention for our staff.

  • We reserve the right to seek full reimbursement for medical expenses, lost wages, and legal damages through your homeowner’s or renter’s insurance policy. You agree to indemnify and hold us harmless from any losses arising from a pet attack on your property.

12. Recording & Marketing Policy

We love showing off a job well done! We reserve the right to take quick photos or videos of our completed work, your yard layout, or your pets (with your implicit comfort) for quality control, staff training, and marketing purposes.

  • These images are handled in accordance with our internal privacy practices and are used for social media, our website, or local print advertisements.

  • Your Comfort Matters: If you prefer that we do not take or use photos of your property or pets for marketing, simply let us know via email or text before your next service appointment, and we will happily note your file.

13. Comprehensive Liability Limitation

While we take extreme care to perform our services to the absolute highest standards, accidents can happen. To the maximum extent permitted by applicable law, Summit Property Care LLC (doing business as 49er Scoops) cannot be held responsible for any indirect, incidental, or consequential damages, injuries, illnesses (including zoonotic diseases naturally occurring in soil or waste), or property losses resulting from the use of our service. Our total liability for any claim arising out of our services shall not exceed the total amount actually paid by you to the Company for the specific service in question.

14. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. While we strive for perfection and a completely spotless yard, we make no express or implied warranties or guarantees that our service will completely eradicate 100% of odors, bacteria, or microscopic waste particles, or that our schedule will be entirely uninterrupted by external forces.

15. Intellectual Property

Summit Property Care LLC retains all intellectual property rights, copyrights, trademarks, logos, and proprietary materials displayed on our website, social media, and service documentation.

16. Governing Law & Dispute Resolution

These Terms of Service, and your relationship with us, shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. If a disagreement ever arises, you agree to first contact us directly so we can work together to resolve the matter neighbor-to-neighbor and informally before pursuing legal avenues.

17. Severability & Modifications

  • Severability: If any single clause of these terms is found by a court to be invalid or unenforceable, that specific clause will be adjusted to fulfill its intent, and all remaining sections of these Terms will continue in full force and effect.

  • Modifications: We reserve the right to update or modify these terms at any time to reflect updates in our business operations or local laws. Any changes will become effective immediately upon being posted on our official website. Your continued use of our services after updates are posted constitutes your agreement to the revised terms.
